I measure the “average width” of the lot to be (200’ + 400’)/2 or 300’. Twenty percent of three hundred feet is 60’—and that is how large the buffer area needs to be to the surrounding residential/agricultural land. KIP 20 LLC/Andrews Management Group have allocated 50’ to the Garden State Parkway, and even then their buildings encroach upon that, and just twenty-five feet to the neighboring residential and agricultural land. Twenty-five is less than sixty, last time I checked. KIP 20 LLC/Andrews Management Group have decided to place two septic fields within that required buffer zone, right next to the potable water well that is used at our barns (the two historic buildings visible to passers by, and now the sole remaining remnants of the historic farmhouse that once existed on this site). This proposed “commercial” development is not even consistent with commercial usage rules!</image:caption>

These used to be rather esoteric systems but, thanks to the era of smartphone navigation, they are now very commonplace. In fact, the NJ DEP hosts a free online system where you can create your own maps from the data that the DEP and the NJ Geological Survey have compiled. In prior posts I have referred to our inference that there are wetlands at 125 Red Hill Road based on "on the ground" observations. Sadly, in the world of official rulings, that is not nearly as strong evidence as the data contained within the GIS hosted by the NJ DEP. That is the definitive data set.</image:caption>

      <image:caption>We received this registered letter today. It was mailed before the Holmdel Township Zoning Board meeting regarding the request for a completeness waiver. It states that KIP 20 LLC, via their agents, have filed an application for a “LOI,” or Letter of Interpretation, regarding the presence or absence of sensitive wetlands on within 200 feet of the 125—127 Red Hill Road Property. We believe there are such wetlands, as can be seen from the map attached to my prior post. In addition, we operate two potable water wells within 20 feet of the property line between 123 Red Hill Road and 125 Red Hill Road and we also operate a potable water well at 121 Red Hill Rd. Since we are at the top of Red Hill, locally, surely this water must be sourced from the properties? Furthermore, we have seen persistent standing water, sometimes called “dew ponds,” to exists on the 125 Red Hill Rd farmland property, clearly visible from our property. Further down the hill water emerges on the southern side of the property, on Crawfords Corner Rd, in a marshland with Skunk Cabbage and a spring that regularly disrupts the blacktop on Crawfords Corner Rd itself.</image:caption>

Their arguments in favour of this waiver were that their own engineers had thoroughly examined the property and found nothing to object to and that the DEP process was slow and it was, in the words of their attorney, "it's unfair that we should wait [for DEP review]."
